PERSONAL WATERCRAFT
1. SCOPE
Bombardier Recrea tional Products Inc. (“B R P”)* warrants its model year 2009
Sea-Doo pe rso na l watercra ft sold by a uthorized BRP distributors/dealers (defined
below) outside of the fifty United States, Cana da and states me mbers of the
European Economic Area (whi ch is com prised of the states member of the Eu-
ropean Union plus Norway, Iceland and Liechtenstein), w il l be free from defects
in material or workm a ns hip for the period and under the conditions described
below. This limited w a rran ty will become nul l a nd void if: (1) the Sea-Doo personal
watercraft was use d for racing o r an y other competitive activity, at any point, even
by a prev ious owner; or (2) the Sea- Doo pers ona l watercr a ft has been a ltered or
modified i n such a way so as to adversely affect its operation, performance or
durability; (3) or has been altered or modifie d to change its intended use.
All genuine BRP parts an d accessorie s, installed by an authorized BRP
distributor/dealer at the time of delivery of the 2009 Se a-Doo pe rson al waterc ra ft,
carry the same warranty as that of the personal watercraft.
2. LIMITATIONS OF LIABILITY
THIS WARRANTY IS EXPRESSLY GIVEN AND ACCEPTED IN LIEU OF ANY
AND A LL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INC LUDING
WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTEN T THAT THEY
CANNOT BE DISCLAIMED, THE IMPLIED WARRANTIES ARE LIMITED IN
DURATION TO THE LIFE OF THE EXPRESS WARRANTY. INCIDENTAL AND
CONSEQU ENTIAL DAMAGES AR E EXCLUDED FROM COVERAGE UNDER
THIS WARRANTY. SOME JURISDICTIONS DO NOT ALLOW FOR THE DIS-
CLAIMERS, LIMITATIONS AND EXCLUSIONS IDENTIFIED ABOVE, AS A
RESULT, THEY MAY NOT APPLY TO YOU. T HIS WARRANTY GIVES YOU
SPECIFIC RIGHTS, AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS
WHICH MAY VARY FROM COUNTRY TO COUNTRY.
Neither the BRP distributor, any BRP dea ler nor a ny other person ha s been autho-
rized to make a ny affirmation, representation or warranty regarding the product,
other than those c onta ined in this limited w arranty, a nd if mad e, shall n ot be en-
forceable against BRP. BRP reserves the right to modify this warranty at any time,
being understood that such modification will not alter the warranty conditions
applicable to the products s old while th is warranty is in effe ct.
3. EXCLUSIONS
The following are not w a rranted under a ny circumstances:
– Norm al wear and tear;
– Routine ma intenance items, tune ups, adjus tm ents ;
– Dam a ge caused by failure to provide proper maintenance and/or storage, as de-
scribed in the Operat or’ s Gu ide;
– Dam a ge resulting from rem ov a l of parts, improper repairs, service, mainte-
nance, mo difications or use of parts not manufa ct ured or approved by BRP or
resulting from repairs don e by a person that is not an authorized servicing BRP
distributor/dealer;
